1. Terms
1.1 All terms will be subject to English Law.
1.2 Us, we, our, are terms that Simply Learning Ltd will be known as herein.
1.3 They, you, candidate, are terms referred to the course attendees.
1.4 Whilst every effort will be made to keep to the advertised course content, Simply Learning Ltd reserves the right to change course content as it deems necessary.
2. Bookings
2.1 We will only guarantee a booking once full payment has been received.
2.2 All quotes are valid for 30 days from the date of the quote. Any available date(s) provided are not guaranteed until payment has been received.
2.3 Candidate names should be supplied, and where there are pre – requisite requirements (i.e., existing cards / certification) then these MUST be supplied prior to confirmation of booking.
2.4 By confirming a booking, you are agreeing to our terms and conditions.
2.5 By confirming a booking, you are agreeing that candidates meet the course prerequisites. *
2.6 Confirmation of bookings, joining instructions and other relevant course information will be sent via email to the booker / company email address.
3. Alterations / Cancellation to a Confirmed Course Booking
3.1 Request for course rescheduling and cancellation must be made in writing.
3.2 We will endeavour to provide alternative dates if a request to reschedule a confirmed course is received. We reserve the right to charge the following charges (3.4) in the event of rescheduling a course not initiated by Simply Learning.
3.3 Where a confirmed course is cancelled by the client the following original course charges, (3.4) will apply.
3.4 Cancellation / Rescheduling Charges:
- 1-10 full working days prior to course delivery date, original course will be invoiced in full, rescheduled course will be invoiced at 50%**
- 11-15 clear working days prior to course delivery date, original course will be invoiced in full, rescheduled course will be invoiced at 25%**
- B16-20 clear working days prior to course delivery date, no charges will be applied, and the booking will be deemed as cancelled.
3.5 Where we cannot offer an alternative date within 30 days of the original course commencement date the booking will be deemed a cancellation, and any payments received will be refunded after any applied deductions listed in item 3.4 (above).
3.6 Where courses are delivered through any of our partner companies, their rescheduling / cancellation charges will apply (available on request).
3.7 Candidate names may be changed at any time without incurring additional charges if candidate numbers stay the same and all necessary prerequisites are provided, and eligibility is confirmed.
3.8 Where a candidate is withdrawn from a confirmed booking then 100% of the candidate rate will be applied.
3.9 Where clients request an earlier delivery date following confirmed booking and this can be accommodated, this will be done FOC.
3.10 Simply Learning reserve the right to cancel a course where minimum numbers have not been attained. Under these circumstances costs associated with item 3.4 will not be applicable.
4. Payments and Credit
4.1 Payment Terms are strictly 30 days from the date of invoice, or before course start date, whichever is soonest. *
4.2 Late or non-payment of an invoice may result in interest being applied in accordance with the “Late Payment of Commercial Debts (Interest) Act 1998”.
4.3 In the event that a client needs to cancel their position on a course, any money paid will be refunded as credit on their account. As soon as the client is ready to book another course, the credit value will be applied.
4.4 Any agreed refunds will be processed within 5 working days by the same method in which the original payment was received.
4.5 Refunds may be utilised for further booking made within 3 months of the refund date, otherwise they will be fully refunded.
4.6 Refunds issued will include a processing fee of costs we incur.
4.7 Certification will be held until full payments are received.
4.8 All payments must be made in pounds sterling (£).
5. Candidate Information
5.1 Please inform us of any physical / learning impairments which may impact the selected training. We will do our upmost to accommodate your needs, but we do require prior notification.
5.2 For any practical training the candidates must be physically fit enough to complete the course. If they have any known medical conditions or doubts about their fitness, then they must make the instructor aware of this immediately.
5.3 Candidates will be responsible for the provision of notified PPE adequate for the course. If appropriate PPE is not available, training/assessments will not be completed, and no refunds will be given under these circumstances.
5.4 Candidates arriving late will not be admitted onto a training course, if, in so doing, this impacts the progress of others, or when the awarding body specifies a set number of learning hours.
5.5 Candidates that do not meet the course prerequisites on the day of the course, including production of required ID, previous certification etc, will be excluded.
5.6 We will try and be as flexible and supportive as possible, however in the event of non-attendance, no admission or exclusion covered by the above, the client will be liable for 100% of the cost of the course.
5.7 Candidates must check individual course requirements as per our website and joining instructions. Failure to meet the requirements may result in the candidate not being admitted and refunds will not be given.
6. Working with Simply Learning Ltd
6.1 All candidates MUST abide by all Health, Safety, Environmental and Fire practices in place at the course location(s). These practices will take preference over all other aspects of the course.
6.2 All candidates will be expected to behave in a manner befitting to the course, which is to dress respectively and appropriately, behave so as not be a disruptive influence on other candidates, refrain from being under the influence of alcohol and/or drugs and not to act in a criminal manner. Failure to do so will result in the candidate being refused entry / ejected from the course and reported to the police if necessary. No refunds will be given in this event.
6.3 We reserve the right to eject any candidate flouting these rules and any neglectful damage to property.
6.4 We will act to recover damages from the candidate or candidate’s employer for any neglectful damage to property or serious disruption to the course caused by a candidate.
6.5 We reserve the right to refuse delegates entry to a course if any fees are outstanding.
6.6 We reserve the right to ask a candidate to leave the class should they not have any basic knowledge of the subject matter if it is deemed that they are holding up the rest of the class, though we will of course, endeavour to provide additional support, though recognise this will not always be appropriate and/or possible.
6.7 Any special requirements of a candidate should be specified on the Candidate Registration Form. We reserve the right to cancel the candidate’s entry to a course if this information has not been provided to us prior to the course delivery date, where it will negatively impact the smooth running of the course.
6.8 Any information supplied to us on the Candidate Registration Form will be treated in confidence and in accordance with our Privacy Statement and current UK GDPR and associated statutory requirements.
6.9 All bookings will be subject to candidates and their employers accepting these terms and conditions which are available upon request.
7. Liability
7.1 Simply Learning Ltd will not be liable if we cannot provide the services to you because of an event beyond our reasonable control. Such events include, but are not limited to, fire, flood, storm, strikes or other industrial action, failure of telecommunications services, war, riot, or any actions of any government or public body, failure, or insolvency of the training centre. If we are prevented from providing services by such an event, we will take all reasonable steps to try and reinstate the provision of the services to you as soon as reasonably practicable.
7.2 In no event will we be liable to you for any indirect or consequential loss that you may suffer.
7.3 Certifications will be sent to you via email and/or post, following the receipt of full course charges prior to despatch. *
7.4 Simply Learning hold no responsibility for any certification/cards lost in the post where a proof of postage has been obtained. *
7.5 All certification/cards will be sent via Royal Mail standard post unless specifically requested to do otherwise, charges may apply for this service.
7.6 Requests for copies of certification are subject to an administration charge if you are a private customer or your business has not trained with us for more than a 12-month rolling period

**Rescheduling charges will not include any previous discounts but will be charged at a % of the full cost.
*Discounts will only be given when a rescheduled course is within 30 days of original booking.
